Historicism in its essence and development
Eternally relevant question about the nature of law and the possibility of knowledge for centuries encourages philosophers and jurists to conduct a tireless search, addressing various areas of humanitarian knowledge. Theoretical law originally had two grounds, to which was later added a third: 1) life of empirical data that gave rise to the legal norms, 2) philosophy, 3) actual legal science. This latter gives a theoretical justification of legal norms, and formulates new regulations and, thus, advances the knowledge of the law to a new level. To explain the nature of law in the legal science uses the achievements of other Humanities – philosophy, which remains quite strong, sociology, history, etc. In this work an attempt is made to review the key aspects of the historicism which has occupied a firm place in the history of philosophy, elucidating and interrelationship of the principles of historicism and the theory of natural law.
Historicism is a principle of thinking, which is based on the idea of gradual organic development of any phenomenon. Each historical stage of history is perceived as a specific and essential component of a unified historical process.
First of all, let's define the main thesis of the historicism, which include the following: 1) the life of society is in a constant state of development – change; 2) historical development is not chaotic-randomly, and in accordance with specific laws; 3) the history of the movement purposefully – the history moving toward the goal; 4) the success or failure of socially significant actions, such as reforms depend on how they conform to the historical laws; 5) metaphysics of historicism differs from the metaphysics of natural law theory, but because historicism is questioning the absolute values, substituting their metaphysical purpose of a historical movement. In this regard, in the present paper:
– the emergence of historicism;
– the basic principles of historicism;
– the provisions of the historical school of law was one of the first manifestations of historicism;
– ideological development of historicism;
– the relation of the positions of historicism to the socio-spiritual values;
–the ratio of historicism and natural law.
